Identify the real arrangement
Record who receives the services, directs the work and pays the applicant. Disclose any ownership or control of the US business. Sole or controlling ownership of the US entity receiving the services raises the TN prohibition on self-employment; do not hide that fact behind a contract. The decisive record is often the signed services agreement together with corporate registers, invoices, reporting instructions, and payment records. If those documents show that the professional is really conducting a personally controlled U.S. venture, TN does not permit that self-directed arrangement. Resolve control and client identity before drafting a support letter.
Match the work to the profession
Use the complete duties and the exact listed qualification rule. A commercial title such as consultant does not automatically identify a TN profession. Canadian or Mexican citizenship is required; Canadian permanent residence alone is insufficient. A useful file separates the academic record, any professional licence, and the employer’s explanation of why each credential fits the listed occupation. A title copied from a job board can fail when the daily duties point elsewhere. Decide whether missing evidence can be obtained honestly; do not substitute a broader résumé for the governing qualification.
Prepare consistent records
Compare the proposed agreement with the supporting explanation and credentials. Explain genuine differences in terminology without changing the work for presentation. For a Canadian citizen, confirm either the eligible port-of-entry or preclearance admission process, for which no TN visa stamp is required, or an employer-filed Form I-129 where appropriate before the prearranged services begin; Mexican citizens generally use the visa process. Sequence the decision: confirm the professional category, test the employment structure, then select the appropriate procedure. A Canadian applicant outside the United States may request TN classification during inspection for admission; an employer may instead submit Form I-129 to USCIS in circumstances where that route fits. Work must wait for the resulting authorization. The employer should retain a short record of the final decision and the documents used.
