Separate dated financial assumptions from family eligibility

THE SHORT ANSWER

Orford applicants comparing immigrant routes should identify which requirements depend on the actual filing and which depend on an individual family member’s case. Before any transfer, the reader must decide whether they personally meet an immigrant classification at all. EB-5 stands on the investor’s capital and jobs; Gold Card stands on the applicant’s separate EB-1 or EB-2 eligibility. A person who fits neither profile should not be comparing prices, because neither payment purchases the missing eligibility.

01

Confirm the EB-5 filing-date capital

The September 7, 2026 checked levels are US$1,050,000 or US$800,000 for qualifying targeted employment area or infrastructure cases. Statutory adjustments begin January 1, 2027; do not invent the later amount or assume a private reservation fixes it. Lawful source and path, at-risk capital, ten qualifying full-time jobs per investor and management or policy-formulation participation remain necessary. A spouse and unmarried children under 21 may qualify as derivatives, followed by two-year conditional permanent residence and Form I-829.

02

Assess Gold Card amounts and child eligibility separately

Processing is US$15,000 nonrefundable per person. After vetting and when instructed, the gift to the United States is US$1 million for an individual applicant or US$2 million for a corporate sponsor; each eligible included spouse or unmarried child under 21 adds US$1 million and processing, subject to actual eligibility and any applicable CSPA analysis. Corporate maintenance and transfer conditions are additional. Gold Card uses existing EB-1 or EB-2 classifications rather than creating a separate statutory category; it is not EB-5, and admissibility and visa availability remain required. Re-verify the current official terms before any money moves.

03

Track the actual residence sequence

Petition approval alone provides neither residence nor work permission. EB-5 generally requires I-829 in the 90 days before the second conditional-residence anniversary; filing does not automatically remove conditions or guarantee repayment. Gold Card gifts are not EB-5 capital or equity, and neither route guarantees approval or timing from a budget date.

04

Test eligibility before comparing what the money buys

Hypothetical example: an Orford couple who ran a lakeside lodge for twenty years sell it and want to retire near their daughter in Florida. A consultant frames the choice as US$800,000 in a targeted-employment-area project against a US$1 million Gold Card gift. EB-5 requires no degree, employer or exceptional record; it requires lawful capital traced from the lodge sale, an investment placed at risk, ten qualifying jobs and the investor’s participation in management or policy. Gold Card uses an EB-1A or EB-2 immigrant basis, but Executive Order 14351 directs the US$1 million gift to be treated as evidence of EB-1A eligibility or of EB-2 exceptional business ability, national benefit and national-interest-waiver eligibility. The official FAQ still requires eligibility for permanent residence, admissibility and visa availability. A retired innkeeper therefore is not excluded merely for lacking a conventional extraordinary-ability, multinational-manager or advanced-degree record, and these facts do not establish that only EB-5 is open. The couple should compare the routes only after reviewing the current official Gold Card instructions and EB-5’s conditional-residence, I-829 and capital-return risks.

05

Trace the lodge proceeds before the project traces them for you

The lodge sale produces a closing statement, a mortgage discharge and a deposit into the couple’s account. EB-5 asks for the lawful source and the full path of the funds, so the file should show how the lodge was bought decades ago, how it was financed, the tax returns covering its operation and the sale documents, ending with the transfer to the enterprise. Gaps that seem trivial to the family, such as an old renovation loan repaid in cash, are precisely what an adjudicator questions. The capital level is fixed by the filing date under the 2022 statute, with adjustment from January 2027; nobody can reserve an amount by paying a promoter early.
