Start with the GOLD CARD eligibility and application overview
Assess the child’s actual eligibility
Eligible joining children generally must be unmarried and under 21; assess any applicable CSPA protection using the individual case facts. A processing receipt does not itself establish a permanent age lock. EB-1/EB-2 eligibility, admissibility and visa availability remain necessary.
Retain the per-person amounts and sequence
Processing is US$15,000 nonrefundable per person. After vetting when instructed, the gift to the United States is US$1 million for an individual applicant or US$2 million for a corporate sponsor; each eligible included spouse or child adds US$1 million and processing, including corporate cases. Corporate 1% annual and 5% transfer charges have additional conditions and new vetting where applicable. Gold Card uses existing EB-1 or EB-2 classifications rather than creating a separate statutory category; the gifts are not EB-5 capital or equity and guarantee neither approval, timing nor citizenship. Re-verify the current official terms before any money moves. Hypothetical example: a restorer of historic meteorological instruments receives a corporate offer to cover a Gold Card amount after she accepts a U.S. research position. She must decide first whether her record supports the claimed EB-1 or EB-2 basis and whether a visa number is available, rather than treating the offer as immigration approval. Her publications, awards, degree records, proposed duties, employer documents, and the applicable visa bulletin address separate questions. If eligibility is viable, she must then identify the principal, each derivative family member, the proper processing charges, and the instructed gift payment. A private reimbursement agreement may affect the commercial relationship, but it is not the applicant’s government payment and cannot replace it. Gold Card does not confer an ownership stake or bypass inadmissibility; it is never a conventional visa. The review is therefore staged. First, identify the immigration classification and the evidence it needs; second, confirm visa availability and each family member’s derivative eligibility; third, follow the published payment instruction for the correct person and amount. A consultant invoice, employer promise, or corporate bookkeeping entry may document a private arrangement, but none settles the government-payment requirement. Keeping those records separate prevents a payment decision from being mistaken for an immigration decision. It also makes it easier to answer later questions about what was paid, when, and on whose instruction.
Use the instruction for the correct payment stage
Because the programme runs through existing employment-based classifications rather than a new one, the ordinary requirements of the classification used still apply, as do the ordinary grounds of inadmissibility. Establish from the official materials which stage of the process involves a payment, who the recipient is, and what form the instruction takes. Successful eligible applicants receive permanent residence through EB-1 or EB-2 as determined by the authorities and subject to visa availability. An alternate chargeability based on a spouse's birth country exists as a reviewable question, not as an automatic exception you can assume while budgeting. If the message is unclear, seek clarification through the applicable official process instead of interpreting an informal summary as permission to relocate. A first review should produce a funds-availability chart that distinguishes an anticipated distribution from money held by the applicant and from money that can lawfully be transferred when official payment instructions arrive. Keep official payment instructions, receipts, and the identity of the payer aligned with the selected route. Because the framework is new and administered through executive action, the terms should be re-verified on the official page immediately before any payment.
