Use citizenship evidence alongside Québec residence

USAvisa field guide · 2 minute read Reviewed 7 September 2026
THE SHORT ANSWER

Living in Sherbrooke and holding Canadian permanent residence do not establish Canadian citizenship. Assess the nationality the applicant actually holds and the activity proposed in the United States. A pending naturalization process should remain described as pending. The first decision is factual: identify citizenship shown by a current passport, not residence, tax status, or an expected ceremony date. Hypothetical example: a Canadian permanent resident who works as a diagnostic-imaging technologist is offered U.S. employment while her citizenship application is pending; she must decide using the nationality she holds now, then compare routes whose conditions actually fit.

01

Identify nationality-based requirements

TN requires eligible Canadian or Mexican citizenship. E-2 requires relevant treaty nationality and enterprise ownership. Different passports within a household can affect procedures; a shared home does not make every person’s status the same. Put each family member’s passport, status document, ownership interest, and intended role in a separate record. That exercise identifies whether treaty nationality or TN citizenship is present for the relevant person. It also prevents a business or spouse relationship from being used as shorthand for an immigration fact that has not been established.

02

Assess other routes independently

L-1 needs a qualifying company relationship, foreign employment and role. EB-5 and Gold Card involve their own immigrant conditions. An unavailable TN route does not make another category automatically suitable. Compare the record to the route’s governing condition before spending money. L-1 requires a qualifying organization and one continuous qualifying year abroad in the preceding three years, while E-2 turns on treaty nationality, committed at-risk funds, and a nonmarginal enterprise. EB-5 requires capital at risk, qualifying jobs, and later conditional-residence compliance.

03

Keep Canadian obligations in the plan

Obtain appropriate advice about Canadian status and tax questions alongside the US assessment. An application does not suspend unrelated deadlines or authorize work while pending. Base commitments on documents already issued and clearly identified future conditions. Make commitments in stages: secure the current identity evidence, document the proposed role or investment, and only then select a filing or admission path. A future citizenship certificate may change later options, but it cannot backdate eligibility. This sequencing prevents an employer deadline from converting a pending Canadian process into an inaccurate U.S. claim.
