Document the services behind a TN contract proposal

USAvisa field guide · 2 minute read Reviewed 7 September 2026
THE SHORT ANSWER

A Sherbrooke professional should explain the actual parties, work and qualifications before relying on a contract label. An independent-services agreement does not itself settle TN eligibility. The evidence must establish the relevant listed profession, citizenship and permitted arrangement. A first document review should end with a one-page checklist matching citizenship, profession, duties, credentials, employer identity, and procedure. Hypothetical example: a landscape architect is offered a Colorado design role through a staffing company; the reader must decide whether the end-client duties, staffing contract, and qualifying degree describe one coherent professional arrangement before preparing evidence.

01

Map the commercial relationship

Identify the recipient, payer and any intermediary and disclose actual ownership or control of the US business. Do not hide a self-employment issue behind employee wording. The arrangement should be assessed as it exists. Use corporate records, the signed agreement, payment terms, and reporting structure to test who is actually receiving and directing the work. The record may reveal a self-directed venture that TN cannot cover. Correct the structure or choose another route before presenting an employee-style letter that conflicts with the commercial facts.

02

Connect the profession with the deliverables

Use the full duties and exact qualifications, with reliable credentials and required translations or evaluations. TN requires eligible Canadian or Mexican citizenship. A consultant title or Canadian address does not replace those facts. The decisive credential is the one named in the applicable professional category, supported by transcripts, licences, and any necessary evaluation or translation. Compare it to the actual duties rather than to an attractive job title. If a required element is missing, a stronger general work history may not cure that specific gap.

03

Complete the appropriate step before working

Confirm the admission, visa or petition procedure and the permission actually available. A client’s signed contract is not a US work permit. Review any changed duties or additional engagement before relying on earlier authorization. After the facts are aligned, choose the procedure and timing. A Canadian applicant outside the United States may ask for TN classification during admission inspection, while an employer can use Form I-129 with USCIS when appropriate. Do not start services because a letter is signed; authorization must cover the actual employer and work.
