Read the general immigrant investor briefing overview
Magog applicants should separate invoice components, official gifts and employer reimbursement before comparing immigrant options. First re-verify the official Gold Card terms before any money moves: the nonrefundable processing fee starts the official application and vetting process, while the gift is requested only after vetting. For EB-5, establish whether ten qualifying full-time jobs and traceable lawful capital exist before subscribing to a project. The two programmes use different legal and financial frameworks.
Identify the EB-5 capital
Read actual use and governing terms instead of treating an invoice total as automatic capital. The usual levels are US$1.05 million or US$800,000 for qualifying TEA or infrastructure cases, with statutory adjustment from January 1, 2027. Lawful source/path, investment risk, ten qualifying full-time jobs per investor and management or policy-formulation participation remain required.
Identify Gold Card’s actual structure
Processing is US$15,000 nonrefundable per person. After vetting when instructed, gifts are US$1 million for an individual principal or US$2 million corporately; each eligible included spouse or child adds US$1 million and processing. Corporate maintenance and transfer conditions are additional. Private reimbursement does not itself select the arrangement or waive EB-1/EB-2 eligibility, admissibility or visa availability.
Keep residence distinct from payments
Petition approval alone provides neither residence nor work permission. EB-5 generally requires I-829 in the 90 days before the second conditional-residence anniversary; filing does not automatically remove conditions or guarantee repayment. Gold Card gifts are not EB-5 capital or equity, and no invoice or reimbursement guarantees approval or timing.
Sequence the eligibility proof ahead of the payment
Hypothetical example: a specialist physician at a Magog hospital, born in a country with long immigrant-visa backlogs, asks whether the Gold Card gift or a regional-center EB-5 subscription reaches permanent residence sooner. For Gold Card, the current official sequence begins with the application and the US$15,000 nonrefundable processing fee; after successful vetting, the applicant is instructed to make the US$1 million gift to the United States. Executive Order 14351 directs that gift to be treated as evidence of EB-1A eligibility or of EB-2 exceptional business ability, national benefit and national-interest-waiver eligibility, so an advanced degree, labour certification or independent waiver record is not a universal pre-application requirement. The applicant must still be eligible for permanent residence, admissible and chargeable to an available visa number. For EB-5, the first documents are the lawful source and path of the capital, generally US$1,050,000 or US$800,000 in a targeted employment area or infrastructure project under the 2022 statute, and the project’s job-allocation model showing ten full-time positions credited to him. Only after each route is measured against its current official instructions does the timing comparison mean anything.
Compare what each approval actually delivers
An approved EB-5 petition leads, after a visa is available and consular processing succeeds, to two years of conditional residence and a required I-829 filing in the 90 days before the second anniversary. For a post-RIA investor, the qualifying investment must be expected to remain invested for at least two years from the date it is made, provided the job-creation requirements are met; it need not remain at risk throughout conditional residence. Residence obtained through an EB-1 or EB-2 classification is not conditional in that sense, so there is no I-829 step, but the selected classification must be adjudicated and the country-of-chargeability queue still applies. The Gold Card gift is treated as evidence for the specified EB-1A or EB-2 basis, buys no equity, creates no jobs and returns nothing at the enterprise level; whether any portion is refundable on refusal must be read on the official program page rather than assumed. The physician should write both timelines side by side using only official milestones.
