Reconcile the two versions of the employment proposal
Magog applicants should resolve material differences between French and English records before relying on them as one agreed engagement. After a refusal, the applicant must decide whether to return to the port of entry with a corrected file or to have the employer file an I-129 so that the corrected evidence is reviewed on paper first. The choice depends on what was wrong: a wording defect can be fixed at the border, a substantive doubt is better answered in a petition.
WHAT THIS GUIDE COVERS
- Identify the agreed duties
- Apply the actual profession’s requirements
- Complete the relationship and procedure
- Describe the accountant’s work, not the controller’s title
- Choose the channel that fits the defect
Separate Canadian residence from each US eligibility condition
A Magog resident may hold Canadian permanent residence while assessing professional work, a transfer or investment. Identify the actual nationality and case facts required by each route. When neither TN nor E-2 is available, the reader must decide whether the employer relationship can be built into a transfer instead. That decision depends on the employer’s corporate structure and on a year of qualifying service, so it should be made before the U.S. offer is accepted, not after a refusal at the border.
WHAT THIS GUIDE COVERS
- Read the TN citizenship test
- Assess the real corporate and investment arrangements
- Keep immigrant conditions distinct
- Identify the routes that ignore nationality
- Ask the employer the questions that decide the route
Trace the real accounts without counting the same money twice
Magog investors should explain the lawful source and complete funding path rather than replace legitimate intermediary accounts with a fictional direct transfer. A useful review ends with a funding ledger, the investor-of-record decision, and a commitment record that can be checked against the enterprise documents. That sequence prevents a truthful source from being described through the wrong owner or a refundable payment from being counted as a completed investment.
WHAT THIS GUIDE COVERS
- Establish ownership and entitlement
- Reconcile the qualifying contribution
- Retain enterprise eligibility
- Decide who the investor of record is: you or your company
Describe the real role history before the US launch
A Magog company should explain a recent promotion without assigning the new title to earlier years of different work. Before incorporating anything in the United States, the company must decide who will own the new entity on paper, because that single choice creates or destroys the qualifying relationship. An owner who takes the U.S. shares personally, however sensible for tax or banking, may leave the Canadian company with nothing to transfer its employee to.
WHAT THIS GUIDE COVERS
- Establish the qualifying service
- Support the proposed US role
- Complete the first-year business evidence
- Draw the ownership chart before the incorporation papers
- What the corporate documents must prove, and what the director must
Compare the actual employment role with the actual capital path
Magog applicants should assess a qualifying company transfer and a treaty investment using the evidence each arrangement actually requires. The reader must decide the order of two events: closing the purchase of the U.S. business and applying for the status that lets someone run it. E-2 needs the funds already committed, so the purchase comes first or sits in a visa-contingent escrow; L-1 needs the acquired business to be a qualifying affiliate before anyone can be transferred to it.
WHAT THIS GUIDE COVERS
- Read the transfer history
- Read the investment commitments
- Use the effective arrangement
- Sequence the purchase and the application deliberately
- What the closing documents must show for each route
Keep family help, funding rights and immigration status separate
A Magog household may share language skills, business accounts or employer benefits. Those arrangements do not give every person the same immigration permission. In a blended household the reader must decide, child by child, whether the legal relationship to the principal exists at all, because a stepchild qualifies only if the marriage creating the relationship occurred before that child turned 18. That date, not the strength of the bond, settles who can be included.
WHAT THIS GUIDE COVERS
- Check actual work authorization
- Review the immigrant family facts
- Clarify who pays the programme additions
- Establish each child’s relationship before listing dependants
- Which document proves what, and what it cannot prove
Compare the actual contribution with the selected programme arrangement
Magog applicants should separate invoice components, official gifts and employer reimbursement before comparing immigrant options. First re-verify the official Gold Card terms before any money moves: the nonrefundable processing fee starts the official application and vetting process, while the gift is requested only after vetting. For EB-5, establish whether ten qualifying full-time jobs and traceable lawful capital exist before subscribing to a project. The two programmes use different legal and financial frameworks.
WHAT THIS GUIDE COVERS
- Identify the EB-5 capital
- Identify Gold Card’s actual structure
- Keep residence distinct from payments
- Sequence the eligibility proof ahead of the payment
- Compare what each approval actually delivers
