From Sherbrooke, what if the support team is not available at the proposed transfer date?

THE DIRECT ANSWER

Assess how the actual staffing affects the role and the requirements applicable to the US operation. Do not claim that proposed resources are already in place. A new-office case and an established operation may require different evidence, but neither permits a fictional staffing account.

Revise the duties and schedule honestly

Identify who will perform the work and whether the applicant’s duties change. Obtain advice before relying on a materially different arrangement. The company’s intended date does not authorize US employment or make an unsupported managerial role qualifying.

Update the launch calendar and duty chart using resources actually available at transfer. If planned hires are late, identify interim authorized workers or vendors, recalculate how much operational work the transferee would personally perform, and decide whether the filing date or requested role must change. Evidence must still establish an uninterrupted qualifying year outside the United States during the prior three, a qualifying relationship between the U.S. and foreign organizations, with the foreign organization doing business and the U.S. organization either doing business or meeting the initial new-office requirements, and primarily managerial or executive duties. A new office has an initial one-year approval and must develop enough capacity to support the qualifying position within that period; an established office should document its current resources, not forecasts. Remember L-1A’s general seven-year maximum. The usual mistake is preserving an obsolete organization chart simply to hold a desired start date.

Hypothetical example: A Sherbrooke assistive-device maker wants its service director to open an American repair operation, but the technicians will arrive three months later than expected. The company should show who handles repairs during the gap and whether the director would temporarily become the main technician. Delaying the transfer or securing real contracted support may protect an accurate managerial plan better than claiming unavailable staff are already functioning.
