MAGOG · E-2 FIELD GUIDE

From Magog, what if the funding route changes before closing?

THE DIRECT ANSWER

Update the actual source and transfer evidence and assess any material change in rights or commitments.

Use the completed path

The earlier diagram should not be presented as history if different accounts were used. A clear revised explanation does not itself guarantee approval or an opening date.

Revise the funding map before closing, not after filing. Identify why the route changed, confirm ownership and lawful entitlement at every new account, and preserve cancellation records for any abandoned transfer. Then reconcile the completed wires with the purchase contract, escrow instructions, business account, and commitments that actually expose funds to loss. The final structure must retain treaty-country nationality, at least half qualifying ownership, and the investor’s ability to develop and direct through ownership or operational control. The amount must stay substantial for that enterprise, beyond discretionary recall, commercially exposed, and tied to genuine nonmarginal operations; restoring an unrestricted refund can undo the planned showing. No E-2 step itself creates a direct route to permanent residence.

Hypothetical example: a Magog dental-laboratory owner planned to fund an American laboratory from a corporate dividend, but a lender requires the closing money to pass through a joint account. Before signing, she should obtain the dividend resolution, lender terms, co-owner acknowledgement, updated escrow instruction, wires, and revised ownership chart. If the new condition lets her withdraw freely, she must renegotiate it or reassess timing. Filing the obsolete diagram would conceal the very path the bank records reveal.
