MAGOG · L-1A FIELD GUIDE

From Magog, can the new management title be used for my entire employment history?

THE DIRECT ANSWER

The history must describe the actual roles and responsibilities at the relevant times.

Keep the chronology accurate

A promotion may change duties without rewriting prior service. Assess the applicable foreign-employment and role requirements using the real progression rather than backdating authority.

Build a dated table of the employee’s real duties, promotion, payroll, leave, and U.S. travel rather than applying the latest title backward. L-1A requires one continuous year of qualifying employment abroad within the three years before the petition with a parent, branch, subsidiary, or affiliate of the U.S. petitioner. The proposed American job must be primarily managerial or executive, supported by the actual delegation of operational work; a title and direct production duties do not suffice. For an established-office case, confirm that the qualifying organization is doing business in the United States and at least one other country; for an initial new-office case, confirm foreign operations and the separate new-office requirements. A new U.S. office receives an initial one-year period and must be positioned to support the qualifying role. Include prior L time when planning against the seven-year L-1A maximum.

Hypothetical example: a Magog commercial bakery promoted its head baker to operations manager four months ago and wants her to direct an affiliated American facility. Her earlier year should remain described as hands-on production unless the contemporaneous records show qualifying management or specialized knowledge. The company should gather payroll, old schedules, promotion minutes, reporting charts, ownership records, and the U.S. staffing plan. Backdating her new authority would weaken the chronology; for an established U.S. office, accurately documented specialized-knowledge foreign employment may qualify, while an L-1A new-office case requires a qualifying managerial or executive foreign year.
