From Magog, can my spouse translate business materials as paid work while holding TD?

THE DIRECT ANSWER

Employment is not authorized in TD status. The proposed work needs its own lawful basis.

Assess the actual activity

Language ability and a useful family contribution do not extend the principal’s TN permission. Review the spouse’s intended tasks and any independent work route before relying on that income.

List every task the spouse expects to perform, who benefits from it, where the activity happens, and whether payment or business value changes hands. TD status permits study but never authorizes employment, so translating brochures, answering customer messages, or invoicing through a Canadian account can still amount to work rather than harmless family help. A shared household, family goodwill, or the principal’s TN approval creates no permission for the spouse to perform those duties; only a separate, genuinely applicable lawful status could. Meanwhile the principal must independently hold Canadian or Mexican citizenship, prearranged professional work in a listed USMCA profession, and that profession’s required qualification, without engaging in U.S. self-employment; a Canadian citizen may seek that TN classification at a port of entry or have the employer file Form I-129. Canadian permanent residence is not citizenship and cannot substitute for either spouse’s basis.

Hypothetical example: a Magog computer systems analyst takes a temporary role configuring a U.S. manufacturer’s database, while his spouse plans to translate the manufacturer’s French product sheets for payment. His computer-science degree and employer letter may support his own TN request, but her TD status does not permit the translation contract. The couple should remove that income from their first budget and confirm whether she has her own lawful work basis before she accepts files, deadlines, or payment.
