The usual filing window is based on the second anniversary of conditional residence, not payment.
Track the actual residence record
A receipt documents a financial event. Keep it distinct from petition approval, immigrant admission or adjustment, and remember that I-829 filing does not automatically remove conditions or secure repayment.
Anchor I-829 calendar to the investor’s admission or adjustment as a conditional permanent resident, not to an invoice, subscription, wire, or petition approval date. Keep evidence of that residence date for the principal and derivatives, then prepare the removal filing for the 90-day period immediately preceding the second anniversary. At the earlier petition stage, trace lawful origin and movement of the standard US$1,050,000 capital. The alternative US$800,000 figure is for a qualifying infrastructure project or targeted employment area; ten eligible full-time positions and management or policy-formulation participation are also required. File Form I-526 for a direct investment or Form I-526E for a regional-center case. Two-year conditions also cover a qualifying spouse and children who are unmarried and younger than 21, or a child who remains under 21 for immigration purposes after any applicable Child Status Protection Act calculation; payment timing neither starts nor completes Form I-829.
Hypothetical example: a Magog precision-woodworking owner pays for a direct American plant many months before becoming a conditional resident. His receipt belongs in the capital trail, while his later residence record controls the removal calendar. He should maintain the Form I-526 package, source documents, job evidence, admission or adjustment notice, and a family anniversary table. Using the equipment-invoice date to schedule I-829 could produce the wrong filing plan despite a valid investment.
