Read the general eligibility basics overview
A resident of the Canton of Hatley may hold Canadian PR and work for a familiar brand. Neither fact automatically establishes the requirements of a US immigration route. A permanent resident whose citizenship application is pending must decide whether to wait for the passport that unlocks TN or to use the nationality they hold today for a route that accepts it. Waiting is not neutral: the job offer, the funds and the family’s schedule all age while the application sits in the queue.
Check the actual nonimmigrant conditions
TN requires Canadian or Mexican citizenship, a listed profession and its qualifications; Canadian PR alone is insufficient. L-1 requires qualifying foreign service, entities and duties, rather than a shared logo or another employee’s approval.
Review the investor’s own case
E-2 requires relevant treaty nationality, at least 50% relevant national enterprise ownership, direction and a real nonmarginal investment enterprise. EB-5 needs the investor’s actual capital and eligibility, while Gold Card retains EB-1/EB-2 eligibility, admissibility and visa availability. A project announcement or private guarantee does not grant personal residence or work permission.
Use the passport in hand, not the one being applied for
Hypothetical example: a quality manager at a Canton of Hatley cheese plant is a French citizen who has held Canadian permanent residence for four years and applied for citizenship last spring. A Vermont creamery offers her a role that would fit the TN management-consultant or engineer categories if she were Canadian, but TN is limited to Canadian and Mexican citizens; her Canadian PR card and her years in Québec change nothing until the citizenship ceremony has happened. Her French passport, however, is itself a treaty nationality for E-2. If she and her husband, also French, are prepared to buy a controlling share of a small dairy-processing business, that route is open now, judged on their irrevocably committed funds, their development and direction of the enterprise and its capacity to be more than marginal. The decision is therefore between accepting the creamery job later as a Canadian on TN, or becoming an investor today as a French national on E-2, and the two are not interchangeable.
Keep the Canadian file alive while pursuing the U.S. one
Canadian citizenship applications require physical presence accumulated before filing, and an applicant who leaves for an extended US assignment should confirm with Canadian counsel how absences during processing affect the oath and the continuing permanent-resident residency obligation. That obligation attaches to permanent-resident status, not to the PR card’s validity. Nothing in a US E-2 or TN admission cancels Canadian status by itself, but neither does a US status pause Canadian requirements. Record the date citizenship is granted; only then can Canadian citizenship support TN eligibility. A pending application should be described as pending in every US document; claiming Canadian citizenship early is a misrepresentation with lasting consequences.
