Households in the Canton of Hatley should assess each person’s actual eligibility and permission rather than rely on a colleague, project announcement or service promise. The first decision is whether a spouse who intends to earn in the United States should travel as a dependant at all. A dependant classification is quick to obtain but may forbid the very work the household is counting on, so compare the spouse’s own eligibility before choosing the simpler admission.
Review work authorization individually
TD status does not authorize employment. Eligible E and L spouses are employment-authorized incident to valid spousal status, with the required status evidence; children do not receive that spousal authorization. Another family’s approval, a shared brand or a pending case does not authorize the proposed work.
Apply family eligibility and the actual residence sequence
Children generally qualify as derivatives only while unmarried and under 21, subject to any individually applicable CSPA protection. Derivative immigrants may enter with the principal or later, but not before. Gold Card requires a US$15,000 nonrefundable processing fee per person followed, after vetting and when instructed, by a gift to the United States; each eligible included spouse or child adds US$1 million plus processing. It uses existing EB-1 or EB-2 classifications and is not EB-5. Re-verify current official terms before any money moves.
Decide between a dependant admission and the spouse’s own classification
Hypothetical example: a dairy-equipment service technologist from the Canton of Hatley accepts a TN role with a farm-machinery dealer in Vermont. Her husband is a registered nurse who expects to keep nursing. Entering as a TD dependant would let him live in the United States and even enrol in courses, but TD carries no employment authorization; a hospital cannot hire him on that status. Registered Nurse is itself a USMCA-listed profession, so the practical route is his own TN, which turns on his citizenship, a state or provincial nursing licence and the health-care worker certification required of nurses at admission. That means a second employer letter, his own credential file and his own inspection, not a note in hers. If his licence review will take months, the couple must decide whether he waits in Québec, travels as TD without working, or delays the whole move; the answer is a calendar question, not a legal shortcut.
Which record settles each person’s permission
For the principal, the employer letter and the profession-specific credential decide the case. For a working spouse, the deciding record is whichever document shows employment authorization for that person: an endorsed I-94 for a qualifying E or L spouse, or an approved classification of their own. A marriage certificate proves the relationship and nothing more. Children remain dependants until they marry or turn 21, after which they need a status of their own, typically a student classification, and no employer benefit or family payment extends the age line. Write down, for every member, the document that authorizes their planned activity; a blank entry means the plan is not yet lawful.
