THE SHORT ANSWER

Applicants in the Canton of Hatley should use the employer’s real duties and terms rather than assume a junior or senior label determines TN eligibility. The reader must decide which route to file: presenting the file at the port of entry, which suits Canadians with a firm start date, or an I-129 petition when the employer wants a written approval before relocation. The choice changes nothing about eligibility, only about who examines the evidence first.

01

Assess the professional requirements

TN concerns temporary professional activity for Canadian or Mexican citizens in listed USMCA professions. Apply the particular qualifications. Degrees from institutions outside Canada, Mexico and the United States require a reliable foreign-credential evaluation, and any US practice licence is a separate question.

02

Describe the effective engagement

Identify employer, responsibilities, remuneration and duration. A sole or controlling stake in the US enterprise receiving the services raises the prohibited-self-employment rule, although a foreign business interest alone is not a blanket bar. A Canadian citizen may apply at a port of entry without obtaining a TN visa stamp, or a US employer may file Form I-129; a Mexican citizen generally needs a TN visa. TD dependants may study but may not work. An internal grade does not change these conditions.

03

Let the degree, not the grade, name the profession

Hypothetical example: a mechanical engineer employed by a Canton of Hatley maker of feed-handling equipment is sent to commission installations at customer sites in New York State. His internal grade is “field service level 2,” and the first draft letter describes him as a service technician. That wording invites refusal, because “technician” is not the engineering profession his degree supports and the listed technologist category has its own separate requirements. The corrected letter states that he will perform engineering duties: load calculations, tolerance verification and sign-off on modifications, all within the USMCA engineer profession, supported by his bachelor’s degree in mechanical engineering. A professional-engineer licence is unnecessary for classification unless the state requires it for the specific work. The grade can stay on the pay slip; it must not become the profession on the letter. He also confirms he owns no share of the U.S. customer, since controlling ownership of the receiving business would raise the self-employment bar.

04

Decide the procedure after the evidence is fixed

Once the letter, degree and citizenship proof are consistent, choose the channel. A Canadian may request TN admission at a port of entry with the complete file, but should not rely on inspection as an opportunity to repair a deficient letter. The employer may instead file Form I-129 with USCIS and wait for a written approval before the applicant travels. A Mexican colleague on the same project would need a visa at a consulate first. Whatever the channel, the engagement must be temporary and prearranged, and a material later change in duties requires fresh review rather than reliance on the first admission.
