Prove the qualifying group beyond shared branding

THE SHORT ANSWER

A business in the Canton of Hatley should identify the actual relationship with the proposed US operation instead of treating a common brand as the whole corporate analysis. The company must decide, before filing, how much of the first year the transferee will spend doing the operating work himself. A launch plan in which the manager drives the trucks is honest but points away from L-1A; the decision is either to hire drivers early enough that his duties become primarily managerial within the year, or to send him under a different arrangement.

01

Establish the relationship and foreign service

Use effective ownership and control evidence to prove a parent, branch, subsidiary or affiliate relationship, together with one continuous qualifying foreign year within the relevant three years. US days do not count toward that year, although a trip does not automatically break continuity. Both qualifying entities must remain active and provide goods or services regularly, systematically and continuously in the US and another country.

02

Support the actual first-year role

L-1A needs primarily managerial or executive duties; first-line nonprofessional supervision does not qualify by title alone. For US doing business of less than one year, sufficient premises and support for that role within one year are required. L-1B needs company-specific specialized knowledge, sufficient premises and financial ability to pay and commence business. Initial new-office approval is limited to one year. Primary work at an unaffiliated client site must remain controlled by the petitioner and must not be labour-for-hire; total stays are capped at seven years for L-1A and five years for L-1B.

03

Plan the hiring so the manager stops driving

Hypothetical example: a Canton of Hatley cross-border trucking company with eleven tractors opens a small terminal in upstate New York and wants its dispatch manager to run it. His draft first-year plan has him dispatching in the morning and covering routes in the afternoon until volume justifies hires. L-1A requires duties that are primarily managerial or executive; a manager who spends most of his week driving is performing the operating work, and the new-office rule asks whether the office will support a managerial role within one year, not whether the founder is willing to work hard. The corrected plan sets dates: a leased yard with an office and secured parking before filing, a part-time dispatcher in month two, two locally hired drivers by month five and a full-time dispatcher by month nine, so that by the extension he directs staff and sets rates, routes and compliance policy. It also confirms he has one continuous year with the Québec company in a managerial capacity, excluding the days he spent delivering in the United States, and that the terminal is owned by the Québec company rather than by him.

04

Which document decides the extension

At the one-year mark, payroll is important evidence of the US terminal’s actual operations. If it lists drivers and a dispatcher reporting to him, that can support a personnel-manager claim; if it lists only him, the petition must still prove through actual duties and operations that he primarily manages an essential function or performs executive duties. The business plan alone is not enough. Keep the lease, carrier registrations, freight invoices, and organizational charts dated at filing and renewal. Initial approval is one year; total L-1A time is capped at seven years, including the first year.
