THE SHORT ANSWER

A North Hatley investor should identify what each record proves before treating a project spreadsheet or completed transfer as an immigration outcome. The first review should produce two separate checklists. EB-5 needs evidence for the lawful source and path of capital, its at-risk placement, the required job creation and the conditional-residence sequence. Gold Card needs an underlying EB-1 or EB-2 eligibility analysis, the official payment instruction and the applicable admissibility and availability review. The immediate decision is whether either route is actually open before funds are committed.

01

Follow an EB-5 job from model to individual case

Examine the methodology, investor allocation and changes between reports. EB-5 requires ten qualifying full-time jobs per investor alongside at-risk capital with a documented lawful source and path and management or policy participation. Current capital is generally US$1,050,000 or US$800,000 in qualifying TEA or infrastructure cases, subject to statutory adjustment from January 1, 2027 and the actual filing rule. A larger aggregate employment estimate neither reduces that capital nor approves the individual petition. For EB-5, test the project’s job model against the individual investor’s allocation, not against a headline total. Retain the subscription documents, escrow terms, economic methodology where relevant, business records and proof of the investor’s management or policy role. The capital must be at risk, and the jobs must meet the applicable rules. If an investor’s source records require a gift, loan, business sale or several accounts, reconstruct the path before filing; a later explanatory letter is weaker than contemporaneous banking evidence.

02

Follow a Gold Card instruction to its actual stage

Confirm whether the request concerns US$15,000 nonrefundable processing per person or the later officially instructed gift after successful vetting. The principal gift is US$1 million individually or US$2 million corporately; every eligible included spouse or child adds US$1 million plus US$15,000. Keep private handling invoices apart. Gold Card still depends on EB-1/EB-2 eligibility, admissibility and availability, and the gift gives no EB-5 investment or repayment rights. Re-verify the current official programme instructions before any money moves. For Gold Card, do not turn a payment discussion into a substitute for classification. Determine first whether the applicant can establish the particular EB-1 or EB-2 basis and whether a visa can be issued or adjustment granted when needed. A payment by the applicant to the U.S. government after official instruction is not an EB-5 investment and creates no return of capital. The decision is whether the classification file is strong enough to justify proceeding, not whether the payment is affordable.

03

Maintain a separate residence calendar

Petition or payment milestones do not independently permit US work or establish residence. EB-5 conditional residence follows the applicable visa admission or adjustment process, with availability and admissibility; the I-829 window is the 90 days before its second anniversary. A revised project model or another payment receipt does not reset that anniversary or guarantee removal of conditions. Hypothetical example: a North Hatley designer of precision beekeeping sensors sells her Canadian company and considers a regional-center EB-5 subscription or a Gold Card request. Her sale agreement and closing statements can explain the capital source, but she must still trace the money through her accounts and determine whether the project credits ten qualifying jobs to her investment. If she pursues EB-5, she must accept that residence is conditional after the applicable admission or adjustment process and that the I-829 stage later examines removal of those conditions. Gold Card does not replace that investment analysis; before any gift payment, she must decide whether her record supports an EB-1 or EB-2 category at all. An inventive product and sale proceeds may be useful evidence, but neither automatically establishes the required classification.
