Hypothetical example: An employee in North Hatley may know a company’s unusual failure-recovery procedures rather than a secret product formula. An L-1B account should explain the substance and level of that knowledge, how it was acquired and why the US assignment actually uses it. A careful first review asks a practical question: which company records would let an unfamiliar reader distinguish advanced company knowledge from ordinary competence? Training histories, internal problem tickets, product-release records and assignments can be more useful than general praise. The review should also match that knowledge to tasks the U.S. operation truly needs performed.

Start with the L-1B eligibility and application overview

01

Describe the diagnosis and judgment

L-1B may concern special knowledge of company products and their international application, or advanced knowledge of company processes and procedures. Knowledge need not be unique or proprietary. Explain the actual difficulty of the recovery work and the employee’s capabilities; simply labelling a procedure critical or claiming a labour shortage is insufficient. Sequence the evidence from the business problem to the employee’s role. State what the U.S. operation must accomplish, identify the organization-specific process or product knowledge needed, and then show how the employee gained it through work and training abroad. Compare the proposed duties with those records. A generic description of troubleshooting, or a claim that the worker is indispensable because hiring is difficult, leaves the central comparison unanswered. For third-party work, contracts and supervision records help establish who controls the work.

02

Prove employment and the US placement

The case still needs a qualifying corporate relationship, a continuous qualifying foreign year within the relevant three years, and regular, systematic and continuous business in the US and another country. US days are excluded from the foreign-year count without every trip automatically breaking continuity. Primarily offsite work at an unaffiliated employer must remain controlled and supervised by the petitioner and cannot be an arrangement to provide labour for hire. A US new office doing business for less than a year needs sufficient premises and financial ability to pay the employee and commence business; its initial approval is limited to one year. L-1B status is capped at five years in total. A calendar review matters as much as the knowledge narrative. Confirm the qualifying foreign year in the three years before the case, then identify prior L time and the requested period. L-1B stay is ordinarily limited to five years, including time in related L classifications. In a new-office case, the first approval is only one year, so the business plan should identify how premises, payroll and revenue will support ongoing operations by extension. A later expansion cannot retroactively supply facts missing when the initial filing was made.

03

Use the applicable special or advanced knowledge standard

L-1B addresses a transfer within qualifying organizations for a person with specialized knowledge of the petitioning organization’s product, service, research, equipment, techniques, management, or other interests and its application in international markets. Select genuine examples showing the employee’s special or advanced organizational knowledge and present use. A petition that opens with the company’s own asset — a formulation, a drying schedule, a control system built in house, a documented method — and then shows who can operate it tends to describe specialized knowledge. Familiarity with an industry platform or attendance at project meetings alone does not establish the standard; knowledge need not universally be unique or proprietary. What may belong to the employer is everything built around it: the specific configuration, the recipes and tolerances programmed into it, the changeover procedures developed in-house, the validation history, the integration with upstream and downstream equipment. The petitioner has to identify the receiving entity, the worksite where the specialized knowledge will be applied, and who will supervise and control the work day to day. Training decks, controlled-access logs, design-change notes and statements from knowledgeable supervisors can serve different functions. If the position mainly calls for skills the applicant will acquire after arrival, the file should not present those future lessons as evidence of already-held specialized knowledge.
