Start with the EB-5 eligibility and application overview
Understand the allocation of qualifying jobs
Each investor generally must support at least ten qualifying permanent full-time jobs, normally requiring at least 35 hours weekly. The investor, spouse and children do not count as qualifying workers. Direct and regional-center cases use different permissible job methods. The project’s aggregate number does not establish the individual allocation, and part-time positions cannot simply be added together as full-time jobs. Start with the investor’s own evidence: tax records, sale documents, loan agreements, gift records and bank statements should tell one continuous source-and-path story. Then examine whether the capital is genuinely exposed to gain or loss under the governing arrangement. A repayment expectation, reserve arrangement or undisclosed side agreement can change the analysis. The project materials must also show how the required jobs will be created and, where indirect jobs are used, why the selected methodology and allocation apply to this investor rather than merely to the project as a whole.
Keep capital, participation and residence distinct
As of September 7, 2026, the general capital amount is US$1,050,000, or US$800,000 for qualifying targeted employment area or infrastructure investment, with statutory adjustment from January 1, 2027. Apply the actual filing-date rule. Capital needs lawful source and path, risk and applicable sustainment; the investor must participate in management or policy formulation, which can include qualifying limited-partner rights. Petition approval alone grants neither residence nor work. Availability and admissibility govern the residence step; I-829 is filed during the 90 days before the second anniversary of conditional residence, not the investment date. The immigration sequence has distinct stages. Petition approval does not itself confer immigration status; conditional permanent residence follows only through the applicable visa or adjustment process when a number is available and the person is admissible. During the conditional period, retain records of the capital, the enterprise and job creation instead of waiting for the removal-of-conditions filing window. A realistic review also asks what happens if construction, hiring or visa availability moves later than the projection, because an updated forecast is not a substitute for qualifying results.
Account for qualifying capital rather than total deal cost
Designation makes an entity eligible to sponsor pooled investments; it is not an endorsement of any particular project, an approval of the offering, or any promise that capital will be returned. Review how the capital will be deployed, the contractual terms, fees and project risks, with independent financial advice as appropriate. Do not describe any enterprise buyback as automatically harmless, or collapse that exception into an investor’s right to demand payment. Read the signed subscription, partnership, operating, and offering documents together, rather than extracting a single favourable provision. Read the distribution and redemption provisions with counsel rather than relying on a summary in marketing material, since a right that looks like a guaranteed exit can be the very term that puts the at-risk requirement in question. Special rules, including qualifying troubled-business job preservation, need their own assessment; an existing payroll is not a universal substitute for job creation. Identify the job-creation method before accepting an economic report or a staffing chart. Current USCIS policy does not, however, impose a categorical rule that an investor contributing borrowed cash must prove how the collateral was originally acquired; any additional tracing depends on the actual lender, borrower and transfer structure.
