Start with the L-1A eligibility and application overview
Account for the work that remains
An organization chart alone does not show how tasks are actually allocated. L-1A requires primarily managerial or executive capacity; a first-line supervisor of nonprofessional staff does not qualify through title alone. Identify real employees or service arrangements supporting the function instead of assigning all daily delivery to the transferee. Build the duty analysis from calendars, reports, budgets, job descriptions and payroll records, not a title on a business card. The decisive question is what the transferee will principally do after admission. A manager may direct an essential function without a large staff, but the file must show discretion at a senior level and a credible plan for others to perform the function’s day-to-day work. For a new office, compare the first-year hiring plan with signed premises, available funding and the actual launch timeline.
Verify the transfer conditions and operating history
There must be a qualifying organizational relationship and a continuous qualifying foreign employment year within the relevant three years. US days do not count toward the foreign year, though a trip does not automatically interrupt continuity. The qualifying group must conduct regular, systematic and continuous business in the US and at least one other country. A US operation doing business for less than one year is a new office: sufficient premises and capacity to support the qualifying role within one year matter, and initial new-office approval is limited to one year. L-1A status is capped at seven years in total. The foreign-employment review should count qualifying days backward from the proposed filing or admission date, excluding time spent working in the United States. Corporate records should also demonstrate the qualifying relationship throughout the relevant period. L-1A stay is ordinarily limited to seven years, including time in related L classifications; a later title change does not erase time already used. A transfer plan should therefore identify the intended role, extension dates, and any longer-term immigration strategy before the executive’s calendar is committed.
Explain authority with evidence of decisions
Explain who performs execution work, what the applicant manages or directs and the authority actually exercised. A share register, subscription agreements, a capitalisation table and board minutes are what establish that the Canadian and U.S. entities stand in a parent, branch, subsidiary or affiliate relationship. The general maximum for managerial or executive L stay is seven years, subject to the applicable rules and individual facts. A person whose main job is directly supervising non-professional technicians is a first-line supervisor, not a manager, unless the technicians are themselves professionals. Evidence should allow assessment of whether the person primarily manages the function rather than personally delivers its services. The strongest records are usually created for business reasons: delegated signing limits, minutes recording decisions, personnel rosters and budgets. If personnel management is claimed, describe the professional or supervisory character of the subordinate positions and what those positions require of the people holding them.
