Use citizenship and the actual route, not the address alone

THE SHORT ANSWER

Residence in Sainte-Catherine-de-Hatley does not turn a Canadian permanent resident into a TN-eligible citizen or establish treaty nationality for E-2. The first decision is to read the passport and status documents as separate records. A PR card answers Canadian residence status; it does not establish the citizenship required for TN and does not itself establish treaty nationality. Before collecting employer or investment materials, choose the route that the actual nationality permits. That sequencing prevents a family from building an otherwise detailed file around a category that is unavailable to its principal applicant.

01

Resolve identity without assuming nationality

A lawful name change and citizenship are different facts. Establish the person’s actual nationality before selecting the TN or treaty-investor analysis. The same Canadian address can belong to applicants who need different procedures; no local US visa rule follows from municipal residence. Hypothetical example: a Mexican citizen who is a Canadian permanent resident is offered an environmental-consulting position in the United States while her Canadian-citizen spouse considers an E-2 purchase. Her Mexican passport, not her PR card, makes TN citizenship analysis possible, but she must use the Mexican visa procedure. Her spouse’s passport and the proposed enterprise’s ownership records settle different questions for an E-2 case. The couple must decide whether the employee’s start date can wait for the visa process or whether the investor route is the live option. Neither spouse can borrow the other’s citizenship by sharing an address or bank account.

02

Examine the relevant qualifying history

L-1 concerns actual corporate ties, foreign employment and US duties, with a specific foreign-capacity distinction for new-office L-1A. EB-5 requires qualifying investment, jobs and participation; Gold Card retains EB-1/EB-2, admissibility and availability conditions. Canadian permanent residence does not replace those tests or guarantee the family’s US permission. Once nationality is settled, use the route’s own record set. An L-1 review starts with the qualifying corporate relationship, foreign payroll and actual US duties; an EB-5 review starts with lawful capital, the investment structure and jobs; Gold Card begins with the qualifying EB-1 or EB-2 basis and the individual or corporate payment structure. The practical decision is whether the family has proof for one route now or needs time to create genuine qualifying facts. A PR card may still matter to Canadian travel or residence planning, but it cannot cure a missing US immigration condition.
