Start with the L-1B eligibility and application overview
Trace learning through actual work
Special knowledge of the company’s products and international application, or advanced knowledge of its processes and procedures, can be relevant. The knowledge need not be unique or proprietary. Describe what the employee learned, applied and can now explain beyond ordinary familiarity; years of travel alone do not establish the standard, and a labour shortage is not the legal test. Hypothetical example: a process technician at a Québec industrial-ceramics manufacturer has learned to calibrate the company’s proprietary kiln-control sequence after diagnosing dozens of failed firing cycles. A U.S. affiliate needs that knowledge while commissioning its first production line. The technician’s dated troubleshooting reports, internal training notes, supervisor declaration and comparison with ordinary operator duties are the records that explain the knowledge; an unsupported claim that the sequence is secret is not enough. The company must decide whether the U.S. assignment truly requires that specialised understanding or only routine equipment operation. If ordinary operators can perform the proposed tasks after brief instruction, the L-1B theory is weakened.
Connect expertise with a qualifying transfer
Establish the qualifying entity relationship, continuous foreign employment year within the relevant three years and regular, systematic, continuous business in the US and another country. US days are not foreign-year days, but travel does not automatically break continuity. A primarily offsite placement with an unaffiliated employer must remain controlled and supervised by the petitioner and cannot be an arrangement to provide labour for hire. A new US operation doing business for less than a year needs sufficient premises and financial ability to pay the employee and start business, with initial new-office approval limited to one year. L-1B status is capped at five years in total. Build the corporate and employment proof before treating a travel schedule as the key issue. Corporate records must show the qualifying relationship, while payroll, leave records and travel dates establish the required continuous year abroad in the three years before the relevant filing or admission event. A new office also needs premises and a credible explanation of how it can pay the worker and begin business. The L-1B total stay limit is five years, including extensions, so an employer should not present a supposedly temporary transfer as an indefinite staffing solution. For an offsite assignment, contracts and supervision records matter because a customer’s control can create a labour-for-hire problem.
Distinguish advanced knowledge from long service
The classification reaches knowledge of the petitioning organization’s own product, service, research, equipment, techniques, management or procedures, or an advanced level of knowledge of its processes. If any experienced greenhouse manager could apply the same methods after a short orientation, the knowledge is general. Begin by writing one sentence a non-specialist could repeat: what the system does, and what the applicant knows about it that a newly hired person with the same degree would not. The legal position does not soften to accommodate secrecy: specialized knowledge must be shown on the evidence, and neither the sensitivity of the material nor the number of years worked establishes it by itself. A file showing knowledge accumulating — a training record, then a project role, then responsibility for the procedure itself — explains how a person came to know something a new hire could not learn quickly. Link each document to an identifiable practice or procedure; merely marking a document confidential does not demonstrate specialized knowledge.
