Start with the L-1A eligibility and application overview
Apply the correct foreign-capacity rule
Under the general L-1 rule, the qualifying foreign year may involve managerial, executive or specialized-knowledge capacity; the US work need not be the same capacity. The L-1A new-office rule specifically requires foreign managerial or executive employment. Establish one continuous qualifying foreign year within the relevant three years, excluding US days without automatically treating each trip as a break. Hypothetical example: a director of an industrial-laundry equipment company has spent fourteen uninterrupted months in Québec setting budgets, approving regional contracts and directing two department heads. The company wants her to establish a U.S. sales office. Payroll registers, tax slips, job descriptions and the foreign organisation chart establish what she actually did during the qualifying year; a later title change cannot backfill management duties. The company must decide whether her U.S. role will allocate work through supervisors and control a budget, or whether she will personally install machines and chase every sale. The first description may support L-1A; the second points away from a primarily managerial position.
Prove the actual US management position
The US position must be primarily managerial or executive with genuine operational support; first-line supervision of nonprofessional workers is insufficient by title alone. Qualifying entities need the proper relationship and regular, systematic, continuous business in the US and another country. US doing business for less than a year is new-office activity, requiring sufficient premises and support for the managerial or executive role within a year; initial approval is limited to one year. L-1A status is capped at seven years in total. For a new office, sequence the premises, business plan, staffing forecast and financial records before filing, then compare the forecast with the role described. A lease, bank evidence and hiring plan should explain how the operation can support management after its first year rather than merely show that a company was registered. For an established office, current payroll and reporting lines may be the more decisive records. The L-1A total period of stay, including extensions, is limited to seven years; time planning therefore belongs in the initial strategy. A request fails when the business plan promises a manager while the submitted workload requires that person to perform the day-to-day production work.
Establish the corporate relationship with records, not branding
The relationship must be one of parent, branch, subsidiary or affiliate, and the petition has to demonstrate it with corporate documents rather than describe it in a covering letter. Identify the essential function or personnel managed, the applicant’s actual discretion and the people or resources delivering routine tasks. Managerial capacity generally means supervising and controlling the work of other supervisory, professional or managerial employees, or managing an essential function of the organization, with authority over hiring and firing or over day-to-day operations at a senior level. Brief US trips need not break continuity, but their days do not count toward the foreign year. Create a duty calendar for the foreign year and a U.S. organization chart that names subordinate managers, professionals or an essential function. The seven-year maximum applies to time in L-1A, and periods spent in L-1B count toward it, so a transferee who already spent time in the United States should locate prior I-94 records before the group commits to a multi-year plan.
