THE SHORT ANSWER

Applicants in Sainte-Catherine-de-Hatley should keep the employment history and investment transaction separate when evaluating two possible routes. The choice begins by identifying the fact that already exists. An L-1 case depends on a real relationship between qualifying organisations and documented employment abroad; an E-2 case depends on treaty nationality, ownership, committed capital and a business the investor will direct. A first review should place those records in two separate folders before comparing convenience. The decision is often clear once the applicant asks whether they are being transferred as an employee or putting their own capital into a venture. To qualify for the employee route, the person generally needs a continuous full-time year abroad with the qualifying organisation in the three years before the relevant application or admission.

01

Do not rewrite the employment history to fit the label

L-1 uses the qualifying corporate relationship, foreign service and actual US capacity. For general cases, qualifying specialized-knowledge foreign work can support a different US capacity; new-office L-1A specifically requires foreign management or executive service. A promotion needs evidence of the new responsibilities and their support, not just a new title. Hypothetical example: the sales lead of a Québec maker of custom stringed instruments has worked there full time for eighteen months and wants to open a U.S. showroom. Payroll, tax records, the foreign job description and corporate ownership documents decide whether there is a transfer case; a personal savings account does not strengthen that analysis. The company must decide whether the U.S. role will be a genuinely supported managerial position, a specialised-knowledge assignment, or mostly retail sales. The label chosen must follow the work. For planning, L-1A has a seven-year maximum stay and L-1B a five-year maximum, including extensions, so a temporary transfer should not be described as a permanent solution.

02

Do not preserve an obsolete price to fit an investment story

E-2 requires treaty nationality and ownership, substantial lawful at-risk capital, direction and a real nonmarginal enterprise. At least 50% relevant national ownership applies to the enterprise, while the investor’s direction is separately assessed. An inventory adjustment should flow into the final capital account and operating plan; it does not determine eligibility by itself. If the applicant instead buys and operates the showroom independently, begin again with the investor records. Passport nationality, ownership documents, source-and-path evidence, signed commitments and the operating plan establish a different route. The investor must decide how much capital to place beyond personal control before applying and whether the business will be more than marginal; a corporate job history cannot substitute for those facts. A company can sometimes make a different E-2 case, but the ownership and direction analysis must still be proved. Mixing the two stories by calling personal savings a corporate transfer budget makes neither route clearer.
