THE SHORT ANSWER

For a Sainte-Catherine-de-Hatley household, selling securities and using joint resources may explain funding, but EB-5 investment and a Gold Card gift have different requirements. The financial comparison comes after the route comparison. EB-5 is an at-risk investment with job-creation and conditional-residence requirements; Gold Card is a payment programme tied to the applicant’s EB-1 or EB-2 eligibility and other immigration conditions. A first review should therefore produce two distinct checklists rather than one net-worth calculation. The decision is whether the applicant can satisfy the qualifying basis for either route before committing money that has a different legal purpose.

01

Document the route from securities to EB-5 capital

Establish the lawful acquisition, ownership, sale and transfer rather than start the history at the final cash balance. General capital is US$1,050,000 or US$800,000 in qualifying TEA or infrastructure cases, with statutory adjustment from January 1, 2027 and actual filing-date review. Risk, sustainment, ten qualifying full-time jobs per investor and management or policy participation remain separate requirements. Hypothetical example: a biomedical patent holder sells royalty rights and considers an EB-5 subscription while also exploring Gold Card through an EB-2 record. For EB-5, the assignment agreement, original patent records, royalty statements, taxes and wire trail determine whether the capital is lawfully sourced and traceable. The investor must decide whether the project offers a supportable job-creation method and whether the capital can remain exposed to loss through the required period. A high personal net worth does not replace those records or the ten-job requirement. The separate EB-2 materials may be useful elsewhere, but they do not prove an EB-5 capital trail.

02

Identify the Gold Card structure before arranging payments

A joint account does not itself select a corporate principal or eliminate family charges. Published processing is US$15,000 nonrefundable per person; after successful vetting, the instructed gift is US$1 million for an individual principal or US$2 million for a corporate principal, plus US$1 million and US$15,000 for each eligible included spouse or child. The Gold Card is not a conventional visa category; EB-1/EB-2 eligibility, admissibility and availability still apply. Payment logistics confer no investment ownership or guaranteed refund. Re-verify the current official programme instructions before any money moves. For Gold Card, start with the principal’s EB-1 or EB-2 eligibility, admissibility and availability, then identify the correct individual or corporate structure and each included family member. The payment must be made by the applicant to the U.S. government and is not an investment in a commercial enterprise. The practical decision is whether the applicant has a qualifying immigration category before following payment instructions. A joint account can show funding authority, but it cannot create EB-1 or EB-2 eligibility, eliminate family charges, or transform the payment into an asset that may be sold or repaid.

03

Use immigration events for the residence calendar

The asset sale does not begin EB-5 conditional residence. Visa admission or adjustment follows its applicable conditions, including availability and admissibility, and the I-829 window is the 90 days before the second conditional-residence anniversary. Petition approval or a gift payment alone provides no general US work permission and promises no completion date. Keep the residence calendar separate from both the security sale and the payment date. In EB-5, conditional permanent residence follows the applicable immigrant-visa or adjustment process, and the I-829 timing is measured from that conditional residence. Gold Card does not turn a payment receipt into admission, employment permission or a guaranteed completion date. The applicant must decide which immigration event actually controls relocation, work and family planning. Treating an earlier financial event as the start of US residence can lead to missed filings or an unsupported move.
