Show how a new office will support the manager’s function

USAvisa field guide · 2 minute read Reviewed 7 September 2026
THE SHORT ANSWER

A new US operation needs more than a proposed senior title. For an L-1A function-manager plan, identify the essential function and the resources performing its underlying work. The company must also establish the qualifying relationship and foreign employment. The first review should produce a corporate chart, foreign-employment timeline, premises record, first-year operating plan, and division of managerial versus operational tasks. Hypothetical example: a Sherbrooke marine-battery equipment manufacturer leases space near Cleveland and wants its Canadian operations lead to open the unit; the decision is whether the plan shows a real office that can support a qualifying role within its first year.

01

Determine the real office history

Use evidence of doing business rather than incorporation alone to assess the applicable framework. Identify sufficient premises and the other new-office requirements. A registration date does not prove every operational fact. Collect the lease, photographs, utility arrangements, bank activity, supplier agreements, and evidence of the foreign organization’s continuing business. They establish different facts and should not be reduced to a certificate of formation. The reader must decide whether the space and resources are sufficient for the activity described, not merely whether an entity has been registered.

02

Describe support within the required period

For new-office L-1A, the operation must support qualifying managerial or executive duties within one year under the applicable rules; initial approval is at most one year. Explain staff and genuine outside resources without claiming planned hires already exist. Verify that the transferee completed one continuous qualifying year abroad in the three years immediately before filing or admission. For L-1A, total stay is generally limited to seven years; for L-1B, it is generally limited to five. The one-year new-office approval demands a plan that can mature into qualifying managerial, executive, or specialized-knowledge work.

03

Retain the actual development record

Track contracts, staffing, finances and duties as the office develops. An initial approval does not guarantee an extension. Assess meaningful changes while records are available rather than rewriting the launch plan later. Preserve contemporaneous evidence of contracts, hiring, revenue, vendor use, and the transferee’s actual calendar. At extension, the decisive question is often whether the business developed as the role required, not whether the original forecast was elegantly written. Change the plan when reality changes and retain the records showing why.
