NORTH HATLEY · EB-5 FIELD GUIDE

As a North Hatley applicant, can more projected jobs reduce my required capital below the statutory amount?

THE DIRECT ANSWER

Job projections do not replace the applicable capital threshold.

Budget the qualifying category separately

The current general figures are US$1,050,000 or US$800,000 for qualifying TEA or infrastructure cases, subject to the January 1, 2027 statutory adjustment and actual filing rules. Fees and analysis costs need a separate accounting from eligible capital.

Keep qualifying capital, government filing charges, project expenses, and household reserves apart. Confirm official charges through current Form G-1055. Extra forecast jobs cannot reduce the statutory investment: generally US$1,050,000, with US$800,000 available only for a targeted employment area or infrastructure project under filing-date rules. The investor must prove lawful source and path, create ten qualifying full-time positions, or preserve them in a qualifying troubled business, and take a management or policy role. A regional-center subscription uses Form I-526E; a standalone direct venture uses Form I-526. Conditional residence runs for two years, and Form I-829 must be filed within the 90-day period immediately preceding the second anniversary to seek removal, while derivative eligibility may cover a spouse and unmarried children below 21.

Hypothetical example: a North Hatley geospatial-software founder sees a project brochure claiming twice the required job cushion and assumes she can subscribe below the applicable capital level. She should request offering terms, location basis, investor allocation, and economic analysis, then budget the full statutory amount separately from administration and legal costs. A healthy cushion may reduce allocation risk, but cannot discount the immigration threshold. Her company-sale and account records must still trace each investment dollar.
