NORTH HATLEY · TN FIELD GUIDE

As a North Hatley applicant, what if the customer ends the assignment before the planned start?

THE DIRECT ANSWER

Reassess the real engagement and any required process before relying on the obsolete assignment.

Use a current basis for the request

A staffing company’s intention to find another customer does not by itself establish the new work. Record what has actually been offered and do not promise admission based on a cancelled project.

Pause the planned presentation when the customer cancels and determine whether a genuine engagement remains. A staffing firm’s promise to locate work is not prearranged employment. Before resetting the date, obtain the replacement customer’s work order, duties, supervision, location, and duration; confirm that the agency offer incorporates them accurately. The applicant must remain a Canadian or Mexican citizen, fit a USMCA-listed profession, satisfy its specific credential rule, and avoid United States self-employment. A Canadian may seek TN admission at a port of entry or rely on an employer’s Form I-129 procedure, but neither route should use a terminated assignment.

Hypothetical example: a North Hatley computer systems analyst expects to configure inventory software, but the retailer cancels two days before departure. He should not travel with the obsolete customer letter or begin unpaid setup for an unnamed substitute. If the agency secures a manufacturing customer, he should compare the new technical tasks with the computer-systems-analyst profession, replace the assignment documents, and select a realistic start date. A continuing payroll relationship alone does not establish the professional work requested at admission.
