Use separate factual accounts of the former work and the proposed US responsibilities.
Show a real change in duties
Explain decision-making authority, staff or functional support and who now performs the specialist tasks. A promotion letter establishes an appointment more readily than it establishes every substantive managerial duty.
Prepare two duty accounts rather than blending the positions: one supported by foreign payroll, evaluations and work product, and another supported by the U.S. organization chart, staffing plan and decision authority. Corporate records must establish a qualifying parent, branch, subsidiary or affiliate that is doing business, while dated employment evidence must show one continuous foreign year within the relevant three-year window. For an established office, qualifying foreign specialized knowledge may precede a managerial or executive U.S. role; new-office L-1A instead requires foreign managerial or executive service. A title or promotion notice cannot prove primary management, and the total L-1A limit is seven years.
Hypothetical example: A Sainte-Catherine-de-Hatley hardwood-flooring exporter moves its logistics specialist into a U.S. operations-manager position. The petition separates her former shipment scheduling and vendor troubleshooting from her proposed authority over budgets, a warehouse supervisor and an outsourced carrier function. Meeting minutes confirm the promotion, but duty percentages, reporting lines and delegated operational work explain its substance. She also gathers pay records for the qualifying year and company registers showing common ownership. The common error would be rewriting the earlier specialist role as management, particularly if the U.S. site is still a new office.
