Your actual knowledge, employment and assignment still need their own assessment.
Use the right person’s facts
A shared title may conceal different experience or duties. Do not treat another employee’s decision as a promise that the government will reach the same result on your record.
Rebuild eligibility from this worker’s record. Confirm one continuous year of employment abroad within the three years preceding the petition for a parent, branch, subsidiary or affiliate. For a non-new office, the qualifying organization must be doing business as an employer in the United States and at least one other country; a new office instead must meet the special commencement requirements. Next, identify knowledge that is special or advanced concerning the company’s products, processes or procedures, rather than ordinary occupational expertise. Tie that knowledge to the proposed US assignment and determine who will control any client-site work; an unaffiliated customer cannot simply hire the worker’s labour. Another approval may illustrate company facts but cannot prove this person’s training or contribution. New-office approval initially lasts one year, and all L-1B time counts toward a five-year maximum.
Hypothetical example: within the Canton of Hatley, a laboratory-information-systems company seeks to transfer a data-migration specialist because a colleague with the same title was approved. Her file should instead trace the fourteen months she spent designing the firm’s validation sequence, the internal modules she knows and the tasks awaiting her in the US organization. Payroll and travel records establish her own foreign service. If her experience is limited to generic database tools, the colleague’s result cannot fill that gap; if her company-specific command is documented, the shared title does not diminish it.
