Your expertise.Across borders.

Hypothetical example: suppose a Sherbrooke employee will transfer to a US affiliate to resolve problems that ordinary product documentation does not explain. L-1B review should identify the actual special or advanced knowledge and how the employee acquired it. Being the person colleagues call for help is useful context but not the complete eligibility test. A disciplined first review produces a knowledge inventory, acquisition timeline, assignment map, and corporate evidence list. Hypothetical example: a Sherbrooke precision-optics company seeks to move its calibration-systems specialist to an Arizona affiliate after a telescope component launch; the record must show what proprietary production knowledge the specialist gained and why the U.S. assignment requires it.

01

Explain the relevant knowledge

Describe the company’s products, processes, procedures or implementation experience involved and the special or advanced character of the knowledge under the applicable definition. The standard concerns company-specific knowledge rather than general skill, though the knowledge need not be unique worldwide or secret. A difficult support ticket does not automatically establish the standard. Start with the actual process: versions of internal manuals, training modules, controlled procedures, project histories, and access records can explain why the knowledge is special or advanced. Avoid calling ordinary familiarity proprietary. The decision maker needs a comparison between standard industry skill and the applicant’s developed understanding of the organization’s methods.

02

Use actual problem-solving evidence

Select examples showing what the employee understood and decided, with reliable records. Explain their contribution without attributing all team work to one person. The US assignment must actually call for the knowledge described. Match each proposed U.S. duty to a documented knowledge item and identify the business consequence if the task is performed by someone without it. This prevents a generic technical job description from obscuring the real role. If the assignment is primarily routine production, revise the analysis rather than exaggerating the employee’s experience.

03

Establish the qualifying employment and organizations

Support a qualifying parent, branch, subsidiary or affiliate relationship, active business operations by both entities and the required continuous year of qualifying foreign employment within the three years before the petition. If the employee will work primarily at an unaffiliated client site, the placement must not be labour for hire and the petitioner must retain control. For a new office, review sufficient premises and financial ability to remunerate the employee and commence doing business; initial approval is limited to one year. L-1B status is subject to a five-year maximum. Use employment records to establish one continuous qualifying year abroad within the three years preceding the relevant filing or admission, and verify the petitioning entities’ relationship independently. The L-1B maximum stay is generally five years. For a new office, the first-year plan must explain how the specialized role supports commencement of business without treating an initial approval as a permanent arrangement. That chronology also distinguishes a temporary transfer from a newly created role.
