A future L-spouse plan does not authorize present US employment.
Review the permission at the time of activity
An eligible L spouse is employment-authorized incident to the appropriate status when the required status evidence is present. Assess the actual proposed visit and role rather than relying on a later expected admission.
Separate today’s field activity from the family’s later admission. The principal must independently establish a qualifying related organization, an uninterrupted year of foreign employment during the applicable three-year period, and company-specific special or advanced knowledge needed for the U.S. role. A spouse becomes employment-authorized incident to valid L-2 status, with appropriate evidence; a planned transfer, approved promotion or future admission supplies no present permission. Before any visit, identify whether the spouse will merely accompany the family or perform productive services. The principal’s L-1B time is limited to five years, so travel and extension records should be retained.
Hypothetical example: A veterinary-imaging software implementation specialist in Sainte-Catherine-de-Hatley is scheduled to demonstrate a proprietary workflow at U.S. clinics. His wife, a photographer, is asked to document installations for pay before their L classifications begin. She declines the assignment until she holds appropriate work authorization. The company meanwhile proves his foreign payroll year, the affiliate relationship, product-specific knowledge and its own supervision of each clinic deployment. After admission in qualifying L-2 status, she may generally work incident to that status, but she should keep the required status evidence. Calling the earlier visits informal assistance would not cure unauthorized productive activity.
