CANTON DE HATLEY · EB-5 FIELD GUIDE

In the Canton of Hatley, does a favourable project announcement approve my personal EB-5 case?

THE DIRECT ANSWER

Read the actual decision and your own case status; one should not be assumed to establish the other.

Identify the scope of the decision

A project milestone may be relevant without proving every individual requirement. Do not treat marketing language as a personal petition decision or completed residence process.

Identify the document behind the announcement and what USCIS actually decided, then assess the investor separately. EB-5 generally requires the standard US$1,050,000 amount, or US$800,000 for a targeted-area or infrastructure investment, plus ten full-time jobs for eligible US workers. Capital needs a lawful source and documented path, must remain at risk, and the investor participates in management or policy formulation. Regional-center investors file Form I-526E; direct investors use Form I-526. Neither project publicity nor another approval establishes personal eligibility, admissibility or visa availability. Successful immigrant processing leads to conditional residence, and Form I-829 must be filed within the 90-day period immediately preceding its second anniversary to seek removal of the conditions. Verify current official amounts and instructions at filing.

Hypothetical example: a Canton of Hatley land-surveying-practice owner sells his partnership interest and considers a regional-center offering promoted as “approved.” He asks for the underlying notice, job-allocation materials and offering terms, while separately assembling the sale agreement, tax records and every bank transfer tracing his proceeds. His own filing would be I-526E, not the project’s notice. Before subscribing, he checks whether ten qualifying positions are credited to his investment and how capital stays exposed. A favourable headline cannot prove his source of funds or complete his conditional-residence process.
