CANTON DE HATLEY · EB-5 FIELD GUIDE

In the Canton of Hatley, can my family move as residents when the project receives a decision?

THE DIRECT ANSWER

The family’s actual immigrant process and eligible derivative cases still need to be completed.

Use individual residence milestones

Review spouse and unmarried-child-under-21 eligibility and any applicable CSPA facts. Immigrant-visa derivatives enter with or after the principal; a project notice is not permission for the household to move or work.

Map the principal investor’s petition, visa or adjustment step, admission, conditional-residence start and removal-of-conditions filing before choosing a family move date. A spouse and unmarried children under 21 may qualify as derivatives, subject to individual age and CSPA review, but a project decision alone grants them no residence or work authority. Collect passports, civil records and each person’s case notices; derivatives generally immigrate with or after the principal, not merely when construction reaches a milestone. The underlying investment must still meet the applicable capital level, trace lawful funds and support ten full-time qualifying jobs. Residence obtained through EB-5 carries conditions, and Form I-829 must be filed within the 90-day period immediately preceding its second anniversary to address their removal.

Hypothetical example: a Canton of Hatley cabinet-components manufacturer invests directly and files Form I-526 while his daughter approaches 21. A press release about factory financing does not start the family’s immigration status. The household should obtain case-specific age advice, preserve the daughter’s filing and civil documents, and avoid booking a permanent move until each immigrant step permits it. His spouse’s ability to work follows actual resident status, not the project’s celebration. Their calendar marks the principal decision, visa processing, entry dates and eventual I-829 window separately.
