The applicable investment requirement still governs the individual case.
Confirm the actual amount and basis
As checked September 7, 2026, capital generally is US$1,050,000 or US$800,000 for qualifying targeted employment area or infrastructure cases. Statutory adjustments begin January 1, 2027; confirm the filing-date amount and do not infer a discount from a headline.
Determine the filing-date capital threshold from the statute and official guidance, not from the promoter’s approval language. US$1,050,000 is standard; US$800,000 applies only to qualifying infrastructure investments or targeted employment areas. Re-verify both figures before committing funds. Keep investment capital distinct from filing charges, legal review, translations, administration and due-diligence expenses, using current Form G-1055 for agency fees. The investor must document lawful source and path, maintain capital at risk, participate in management or policy formation and support ten full-time qualifying jobs. Use Form I-526E for a regional-center investment and Form I-526 for a direct enterprise. Form I-829 must be filed within the 90-day period immediately preceding the second anniversary of conditional residence.
Hypothetical example: a Canton of Hatley modular-housing designer reviews a direct insulation-panel plant whose development announcement calls it a priority project. She does not subtract a promotional rebate or assume the lower statutory level. Instead, she verifies whether the location independently qualifies for targeted-area treatment, traces retained earnings from her design company and tests a ten-job payroll model. Her budget shows the investment, filing charges and professional expenses on separate lines. Project enthusiasm cannot lower the capital Congress requires for her filing category.
