A shared brand does not itself provide the spouse’s employment authorization.
Use the actual status and permission
An L-2 spouse is employment-authorized incident to valid spousal status, with the required status evidence. A pending case or company introduction is not that permission, and the actual proposed activity should be reviewed.
The spouse’s permission comes from L-2 spousal status, not from a brand, worksite or introduction by the principal’s employer. Qualifying L-2 spouses are employment-authorized incident to status, so the household should obtain and inspect the endorsed status evidence before the spouse starts work. Children do not receive that spousal employment benefit. Meanwhile, the principal’s L-1A case still requires a related active organization, one continuous qualifying foreign year within the prior three and primarily managerial or executive US duties. A new office begins with one-year approval, and total L-1A stay is generally limited to seven years. The common error is treating a pending extension or family application as present authorization.
Hypothetical example: the finance director of a Canton of Hatley composting-equipment distributor transfers to manage its controlled US subsidiary. Her husband is offered bookkeeping work at another outlet using the distributor’s trade name. He should wait until his own L-2 status evidence is effective; whether that outlet shares the brand is irrelevant to his authorization. The family gathers marriage and admission records, checks each validity date, and sets a separate review for their teenager’s activities. His first lawful workday follows his status, not the principal company’s enthusiastic welcome.
